| 摘 要： | 我国环境公害犯罪刑事责任方式的现状是,立法规定单一薄弱、司法适用相对多元。基于环境公害犯罪特殊性、刑事责任目的、现有责任方式缺陷、中外立法对比以及司法实践探索考察,完善环境公害犯罪刑事责任方式必要且可行。立法方面,主要是改进财产刑和资格刑,配置非刑罚处理方法;司法方面,大胆适用以恢复和保护环境为目的的非刑罚处理方法。此外,应根据环境公害犯罪主体的不同,对自然人和单位规定和适用不同刑事责任方式。

| Abstract: | The present situation of the forms of criminal responsibility of environmental hazards crime is that single and weak legisla？tion,relatively diverse judicial application. Based on the particularity of environmental hazards crime,criminal responsibility purpose,and defect on the existing liability methods,legislation comparison and judicial practice,to perfect the forms of criminal responsibility of envi？ronmental hazards crime is necessary and feasible. On one hand,to improve the property and qualified punishment,and to add non-penal？ty methods in legislation;on the other hand,bold attempt to non-penalty methods in justice,whose purpose is to restore and protect the en？vironment. In addition,individuals and units should be treated differently. |
