| 摘 要： | 在当下的中国,选择何种刑事法治,对于和谐社会的建设效果具有重要影响,这在根本上是刑事政策模式的选择问题。宽严相济政策是中外刑事政策实践的最新成果,他代表了现代刑法的发展方向。在司法实践中,非刑罚处罚制度正是这种刑事政策的生动体现,他对于保障人权,打击犯罪无疑有着积极的意义。但我国目前的非刑罚处罚制度还有很多不足,需要在宏观、微观两个层面进行完善。

| Abstract: | In immediately China,chooses what kind ofcriminal government by law,has the important influence regarding theharmonious society's construction effect,this in on basic is thecriminal policy pattern choice question.The width strict aids thepolicy is the Chinese and foreign criminal activity policy practicenewest achievement,it has represented the modern criminal lawdevelopment direction.In the judicial practice,the non-penaltypunishes the system is precisely this kind of criminal policy vividlymanifests,it regarding the safeguard human rights,the attack crimehas the positive significance without doubt.But the our country atpresent non-penalty punishes the system also to have very manyinsufficiencies,needs in macroscopic,the microscopic twostratification planes to carry on the consummation. |
