| 摘 要： | 正确定罪是正确量刑的前提，而能否正确定罪又有赖于对罪数形态的正确认定。毫无疑问，对于贪污罪而言，研究贪污罪的罪数形态具有重大的意义。文章从罪数形态的一般理论入手，对贪污罪一罪类型中的法规竞合犯、转化犯、连续犯和牵连犯以及数罪类型进行了梳理，以期对我国的司法实践活动有所裨益。

| Abstract: | Correct sentencing is the premise of correct punishment, while correct sentence depends on correct recognition of the form of quantity of crime. Undoubtedly, the research of the form of quantity of crime is very important. It is proposed in this paper that the research should start from the general theory, so that the legal violator, it is studied the transformed violator, continuous violator and implicated violator of the types of one crime and the types of plural crimes in corruption to contribute to China＇ s judicial practical activities. |
