| 摘 要： | 在社会进步与历史沿革进程中,社会主体之间法律观念日渐交融,法律制度日渐趋同,法律关系日渐密切,法律成果日益在共享机制下展示其普适性和共通性,形成了法律文化的同构性。同构的概念既有动态的特征,又有静态的内蕴;同构的运行既在内层结构,又在外层系统。传统与现代的分析工具是解释法律文化同构性的一种有效选择。同构性体现了法律发展与社会发展内在规律的一致性。

| Abstract: | In the course of social development and historical evolution,among social entities,people's legal ideas are increasingly mingled with one another,their legal provisions are becoming more and more unamimous and their legal relationship is getting much closer.Within a sharing mechanism,their legal achievements have demonstrated their adaptability and universality,thus forming the uniformity of legal culture.The concept of uniformity of legal culture is both featured dynamically and statically contained.It worksin its inner struture and outer structure as well.One efficient way to define the uniformity of legal culture is to apply the traditional and modern analytical tool.The uniformity of legal culture shows the consistency in the inner law of legal progress and social development. |
