| 摘 要： | 采用文献资料法、专家咨询法、逻辑分析法对高校体育运动伤害中学校应承担责任进行了法律层面的分析.认为高校体育伤害事故产生原因复杂,形式多样.归责原则(过错责任原则、无过错责任原则、公平原则责任)认定应具体条件具体分析.确定责任时要明确高等学校的性质、学校与学生的法律关系;高等学校应承担的责任有直接责任、间接责任和无责任. |

| Abstract: | Through literat ure st udy , expert interview and logic analysis , university liability in sport s accident was analyzed. There were many causes of t he sport s injuries. And t here were direct and indi2 rect liability and no liability. In defining the univer sity liability , character of t he school , legal relation between the school and the st udent s should be clarified. Fault liability principle , no2 fault liability principle and principle of fairness should be followed. |
