| 摘 要： | 随着公司经济力量的增强,及由此带来的社会问题,要求公司承担社会责任的理论应运而生.本文首先回顾了该理论发展演变的历史过程,然后重点对之进行了法理学上的思考.公司的社会责任与法理学上的"道德与法律"、"个人利益与社会利益"、"权利与义务"等范畴有着密切联系.公司本质是追求营利,为股东创造最大利益,但就掌握社会大多数资源与财富之公司角色而言,对社会应尽其积极的社会责任.

| Abstract: | With the growing economic power of companies and social problems incurred , theories about the social responsibilities that corporation should bear emerge accordingly.The thesis first looks back on the development process of the theory, then mainly reflects on it in the view of jurisprudence.Corporate social responsibility is closely related to the concepts in jurisprudence like "morality and law","individual and social interests","rights and obligations". Essentially companies are to pursue profits and maximize the shareholders' interests. However,with large numbers of social resource and wealth they should perform their active social responsibilities. |
