| 摘 要： | 在开放获取背景下，知识共享许可协议已经成为解决著作权的有效法律工具。知识共享许可协议中国本土化具有合同法基础，它的作用是不可忽视的。文章对2012年公布的中国版CC3．0许可协议内容进行了解读，并对其在应用过程的争议问题提出思考。未来CC许可协议的发展应该针对不同用户的需求，开发出相应的演绎模式，使知识共享许可协议更加本土化。

| Abstract: | Under the background of open access, the creative commons license has been an effective legal tools to resolve the copyright. The localization of creative commons license in China has the basis of contract law. Its role cannot be ignored. This paper has analized the contents of Chinese CC3.0 version published in 2012 ,and put for- ward the thought to the controversy over its problems in the proess of application. The author believes that the chi- nese CC version should aim at the needs of different audience in future to develop the corresponding interpretation model, and make the creative commens license more localization. |
