| 摘 要： | 犯罪本质问题是刑法学研究中的一个重大问题,我国学者们对这个问题的探讨过程中出现了严重的社会危害性理论和法益侵害说的对峙,至今也没有形成一个确定的结论。犯罪本质问题所要解决的是犯罪行为与其他一般违法行为之间所具有根本不同的内容,而实际上,无论是社会危害性理论还是法益侵害说,都不能真正明确的、一次性的将犯罪行为与一般违法行为区分开——无法解决犯罪本质问题,而问题的根源就在于刑法、民法、行政法之间根本并不存在一个清晰的分界,对罪与非罪的问题也就无法从理论上作出一个清晰明确的分界标准。这就导致了在现有的理论语境下讨论犯罪本质问题是无法得出一个真正确切的结论的,也就是说犯罪本质问题其实只是一个伪命题。但不应当否认探讨犯罪行为与其他一般违法行为的区分,即罪与非罪的问题所具有的积极意义。

| Abstract: | The nature of crime is a major problem in the criminal law research. Our scholars have in-depth studied this problem,and the views of scholars conflict between the harm-to-society theory and the infringement of legal interest theory. Through the analysis, this article pointed out that the nature of crime to be solved is searching fundamental different between criminal behavior and other violations. In fact, whether the harm-to-society theory or the infringement of legal interest theory,can not distinguish criminal behavior and other violations clearly and disposable. The theories can′t resolve the problem of the nature of crime because of criminal, civil, administrative law simply does not exist a clear demarcation, so we can not make a clear demarcation criteria in theory on crime or not. It causes can not be concluded on the nature of crime problem in the context of the theories. So the nature of crime problem is a pseudo-proposition. But the paper dose not deny the positive significance of explore the distinction of criminal behavior and other violations. |
