| 摘 要： | 物权法草案中对公法和私法关系的处理存在一定的问题。物权法是民法的一个重要组成部分,是典型的市民社会的法律。因此,在物权立法中坚持私法原则,维护私权利,并处理好公法与私法、公权力与私权利的关系,做到立法上公法和私法的和谐,也就成为了判断物权法草案恰当与否的一个重要标准。但是草案中的一些内容却在公法和私法的问题上没有做到和谐。构建和谐社会和法治社会,在物权法立法上处理好这些问题是十分必要的。

| Abstract: | There is a definite problem when the public law and private law are managed in Property Law (draft). It is not only an important part of the matter right draft, but also a typical law of citizen society. This paper points out that in Property Law(draft), there exist some contents in the problem of the public law and the private law which are not in harmony. |
