摘    要:劳动关系是从传统雇佣关系中分离出来的法学领域,除受私法的调整外,还得到公法的较好保护。区分劳动关系和雇佣关系的根本分界线是人身依附性标准。在劳动关系中,劳动者的劳动完全受到用人单位的支配,无需提供任何生产资料,其劳动呈连续性和唯一性的特征;劳动关系相对稳定,劳动者享有各项劳保待遇,解除时也可得到一定的补偿。在雇佣关系中,雇工与雇主的关系相对松散,不存在人身依附性。雇工经常被要求自带劳动工具,不享有任何劳保待遇,雇主按约定支付劳动报酬。雇工与雇主之间的关系完全依约定产生,不具有连续性和唯一性的特征。

Abstract:As a new legal domain bred from the traditional domain of employment relationship, labour relationship is not only protected by private law, but by public law as well. The basic standard of demarcation between employment relationship and labour relationship is the standard of personal attachment. In labour relationship, the labourer is completely dominated by the employing unit, and is not obliged to provide production materials. The service he provides carries the characteristics of continuity and exclusiveness. The labour relationship between them is comparatively stable, and the labourer enjoys various types of fringe benefits. The labourer enjoys the right to a certain degree or amount of compensation upon the recession of labour contract. While in the case of employment the relationship between the employer and the employee is comparatively loose, without any personal reliability. Commonly the employees are required to bring working tools along with them and enjoy no fringe benefit. The employer pays remuneration as agreed. The relationship between the employer and the employee is solely based on their agreement, and no continuity and exclusiveness exist.
