| 摘 要： | 我国法学界对抵押权的物权性已有充分认识，但现行立法的规定却比较模糊，没有真正体现抵押权的物权性，这直接影响到抵押权各项法律制度设计的合理性，影响到抵押权担保功能的发挥。建立和完善抵押权公示制度、登记制度及善意取得制度是完善抵押权物权性立法的重要前提。

| Abstract: | Though China's law field fully understands the real right character of mortgage, there is no clear expression in China's current legislation, which has a direct effect on the reasonableness of concerned laws and the function of guarantee of mortgage. It is essential for China's legislation of the real right character of mortgage to build and perfect mortgage-promulgating system, registration system, and hold-in-good-faith system. |
