| 摘 要： | 我国《侵权责任法》所阐述的立法目的,能够有效地保护民事主体的合法权益、预防侵权行为、制裁侵权行为,并促进整个社会的和谐稳定。但也存在缺乏立法根据、忽视对受教育权的保护等问题。
