| 摘 要： | 宪政文化的创新，首先是立法文化与宪法文化的创新。宪政是动态的运行中的宪法，是一个极具人文气息的概念，但二者还是存有根本性的区别。宪政创新的主要内涵是指依照宪法规定所产生政治制度的创新，是宪法规范与实施宪法相结合产物的创新。宪政文化以宪法文化的发育、培植、养成为前提，承载着一个民族的心理与一国的国情，体现了权利→←权力结构与制约宪政精神之碧华。

| Abstract: | As to the innovation of the constitutional culture, it first refers to the innovation of the culture of the legislation and the constitution. Constitutional is the constitution that is running all the time, and it is a concept that is full of the human- istie spirit. However, there exists some differences, especially some fundamental differences between the two issues. The main connotation about the innovation of the constitutional is a kind of innovation in political system, which is created by the consti- tution. It is also a kind of innovation that is created by the combination of the constitution norms and the practice of the consti- tution. In addition, the development of the culture of the constitution is the premise of the constitutional euhure, which bears the psychological of a nation and the conditions of country. The constitutional culture reflects the rights, the power structure and it also constraints the essence of the constitutional spirit. |
