| 摘 要： | 土地财产权重心的下移是从注重土地所有权到土地使用权,再到注重土地处分权。土地财产权重心下移的基础在于土地归属、土地利用和土地流转价值目标体系的完善。土地的相对性处分权利是土地流转和市场化的权利基础,包括转让权、出租权、抵押权、出资权和继承权等权利内容。土地财产权制度改革的关键在于＂同地同价同权＂,亦即处分权的平等赋予,这同时需要政府与市场的有效分工和结合。

| Abstract: | The lower center of gravity of the land property rights,is from focus on land ownership to on land-use rights,once more to pay attention to the disposition of land use rights.It is based on improving on the value of the land system,such as land ownership,land use and circulation.The right to dispose of land use right,is the basis of the transfer and market-oriented of land rights,which including the right to transfer,leases,mortgage,investment and inheritance etc.The key about land property rights reform of the system lies in ＂with the same price with the right＂,which is given equal powers.At the same time the government and the market need for an effective division of labor and integration. |
