| 摘 要： | 民事证明责任倒置是证明责任分配一般原则必要的有益的补充。它的产生与社会进步，人类对公正、正义等价值的追求有着密切的联系。证明责任倒置是实体公正和程序公正的统一，是实现诉讼效益的保障。它的存在是必要的。

| Abstract: | The inversion of the civil proof responsibility is proved the necessity and beneficial supplement of the assignment of the civil proof responsibility. Its appearance is related with the society progressive and the pursuit to fair justice and so on. The inversion of the civil proof responsibility is the unification of the entity fair and the procedure fair. It is the protection of the lawsuit benefit. So its existence is necessary. |
