| 摘 要： | 罗尔斯正义理论的形成经历一个过程,从《作为公平的正义》到《分配的正义》再到《正义论》,逐渐摆脱了功利主义影响而走向规范主义。其思想精髓在于:“原初状态”和“无知之幕”的设计;两个正义原则(自由平等原则和公正原则)的证明;自由的优先原则、正义的优先原则和正当对善的优先原则。罗尔斯的正义理论对我国建设社会主义和谐社会,正确处理自由与平等、公平与效率的关系,切实保护弱势群体,维护代际正义,都有着十分重要的价值。

| Abstract: | The formation of Rawls' Theory of Justice underwent a process,from Justice as Fairness to Distributive Justice,and then to the Theory of Justice.In the process,it freed itself from utilitarianism gradually and was normalized.Its theoretical quintessence lies in 'original position' and 'veil of ignorance',and it lies in the testimony to the two theories of justice(freedom and quality) and it lies in the notion of freedom,justice and proper attitudes toward kindness to prevail.To practically protect the disadvantaged and keep social justice,Rawls' Theory of Justice is of great value in constructing a harmonious social society and handling correctly the contradictions between freedom and quality,fairness and efficiency. |
