| 摘 要： | 在中国司法改革的进程中,我们需要正视民意与司法的矛盾冲突之社会现象。面对民意对司法专业化提出的挑战,固然可以采用司法民主化的方案来应对,但根本则要通过社会基本结构的改革来化解。可以说,司法中的民意构成了推动司法改革向前迈进的契机。

| Abstract: | The contradiction conflicts of people will and judicatory in the judicial field are becoming the social phenomenon that can't be ignored.Facing the challenge of judicatory specialization from people will,we should not only deal with the scheme of judicial democratization,but also fundamentally reform the basic structure of society to solve the problem.People will is a critical point that can push forward the reform of judicatory deeply. |
