| 摘 要： | 恢复性司法源自西方,其与市民社会的发达有着密切的关系.我国传统的社会结构呈现政治国家一极独大,市民社会极不发达的局面,即使改革开放之前的我国亦是如此,这样的社会结构不利于恢复性司法的践行.近年来,随着社会主义市场经济的建立和发展,市民社会慢慢在我国起步,这为恢复性司法在我国的践行提供了一定的社会结构空间,但还远远不够.以恢复性司法基本理念为指针,着力在我国培育与壮大市民社会,从而使恢复司法在我国的践行逐渐获得一个较大的社会结构空间,应当是我们理性可行的选择.
