| 摘 要： | 在我国,公立高等学校提供的教育服务具备公共产品的某些特征,但又不完全齐备,属于准公共产品。高校管理权具有行政权的属性,属于公权力。高校处分权可分为改变学生身份的处分权和未改变学生身份的处分权两类,前者具有公权力的性质,后者属于高校办学自主权的范畴。

| Abstract: | In China,the education services provided by the public universities have certain characteristics of the public products,but this is not entirely complete.It belongs to a kind of quasi-public product.The right of the administrative management of the universities has the nature of administrative power and belongs the public authority.The right of disposing the students can be divided into such two kinds of right as the right to change the status of the student and the right to the contrary.The former has the nature of public power,while the latter belongs to the autonomy areas of the university. |
