| 摘 要： | 互联网的迅速发展给人们的生活带来了巨大的变化。网上购物,作为一种新兴的购物模式已经逐渐深入人心。然而网上购物中存在的问题也不容小觑。与传统的纸质合同不同,网上购物涉及的电子合同在合同的订立、成立、履行等方面存在巨大的差异。格式条款因其简化交易过程、方便预测潜在风险而成为网上购物的必然选择。但是事物都有两面性,格式条款在方便交易的同时,也给人们的生活带来了预料之外的困境。本文阐述格式条款存在的问题并提出相应的解决对策,以期网上购物能够在正确的环境下蓬勃成长。

| Abstract: | People’s life has a great change with the development of internet.A new style of shopping,on-line shopping has been accepted by more and more people.But on-line shopping has its drawbacks.Different from traditional contract,e-contract has its own characters in the conclusion,establishment and performance of a contract.This paper focuses on the emerging problems of concluding an on-line shopping contract.Because of its convenience,Standard contract clauses are widely adopted.Every coin has two sides.It also brings troubles.The paper aimed at analyzing the problem of standard contract clauses and giving some solving methods,in order to make online shopping vigorous in right environment. |
