| 摘 要： | 中国传统法理集中体现为礼法精神,这是与西方法理的一大感象区别。中国古代法律制度诸法合体,刑民不分,以刑为主。民事法律制度落后,官方民事纠纷解决机制不发达。民事矛盾的大量存在为民间纠纷自生自长的解决方式提供了深厚的土壤。中国人善于化干戈为玉帛的处事方式使调解在中国民事纠纷的解决中扮演着重要的角色,逐渐形成了调解法理。调解法理集中体现为礼法精神,调解将纠纷化解在诉讼之前,所追求的效果是息讼,以至无讼,这正反映了中国的礼法精神。调解与中庸之道切近,包容精神相通,调解的核心内涵与中国传统法理的价值追求相切合。

| Abstract: | Chinese traditional legal centralism manifests as the spirit of Confucianism ,which is a great sense of western legal difference . The ancient Chinese legal system of the law , punishment , regardless of people , is given priority to punishment . Civil law system , the official civil dispute settlement mechanism is not developed .Civil conflict has its root cause .Chinese people are good at an olive - branch manner and solving the mediation of civil disputes in China plays an important role , which gradually formed a legal mediation . Legal centralism manifests as the spirit of Confucianism ,mediation to resolve disputes before litigation ,the effect of pursuit is quell the litigation . It reflects the spirit of Confucianism in China .Mediation and golden mean closest and inclusive spirit are interlinked ,with mediation at the core of the connotation and the value pursuit of the Chinese traditional legal theory is appropriate . |
