| 摘 要： | 关于医患关系的法律属性,学者们意见不一,司法机关认识也不一致。将医患关系归属为消费关系存在不足之处,医患关系不应认定为消费关系,医患关系应属于民事合同关系。

| Abstract: | It is disputed on the legal attribute of medical relation among scholars,as well as judicial authorities.Based on analyzing current law,this is points out that it is unsuitable to regard the medical relation as the consump-tion relation,and draws a conclusion that the medical relation is a kind of civil contract relation. |
