| 摘 要： | 离婚过错赔偿制度是我国修改后的《婚姻法》反映人民意愿、顺应时代潮流而新增设的一项重要法律制度。本拟从离婚过错赔偿制度的构成要件、法定原因、权利和责任主体以及赔偿方式和数额等方面对其具体适用过程中的问题进行研究和探讨。
