| 摘 要： | 随着我国竞技体育职业化、商业化、市场化程度的不断提升,愈来愈多的竞技体育纠纷已成为制约和影响我国竞技体育事业健康发展的社会性问题,如果不能有效地解决,其聚焦风险将引发竞技体育纠纷的"破窗效应"。因此,在阐述竞技体育纠纷"破窗效应"形成机制与类型,分析了我国竞技体育纠纷的法制漏洞,提出了我国竞技体育纠纷破窗效应法制化规避的具体措施,旨在净化我国竞技体育市场环境。研究结论如下:市场经济环境下竞技体育利益相关者之间利益分配相互博弈的过程中引发了竞技体育纠纷的"破窗效应";我国竞技体育纠纷"破窗效应"的类型主要表现在合同纠纷、竞赛纠纷和行政纠纷三个方面;我国竞技体育纠纷的法制漏洞包括:《体育法》存在用语不合乎逻辑,规定过于原则,过多倾向于行政手段和控制机制,淡化了竞技体育的市场化色彩,以及体育法"有关规定"缺乏科学性的问题,建议修订与完善竞技体育纠纷章节内容、推敲使用语言,消除概念的模糊性、增加《体育法》第四章(竞技体育)条例来做好《体育法》的修订与完善工作。

| Abstract: | Along with our country competitive sports professionalization and commercialization,the improving of the degree of marketization,has become more and more competitive sports disputes and affect the healthy development of the cause of athletics sports of our country’s social problems,if you can’t effectively solve,the focus on risks will lead to a “broken window effect” of the competitive sports disputes. Athletic sports disputes, therefore, the paper“broken window effect” formation mechanism and types, analysis of loopholes and problems of China’s “sports law”,on the basis of proposed our country revises “sports law” and perfect Suggestions,aims to purify the market environment of legal system of athletics sports of our country. Research conclusions are as follows：the market econo-my environment of competitive sports in the gaming process of distribution of interests among stakeholders of the competitive sports disputes “broken window effect”;The dispute of athletics sports of our country the type of “bro-ken window effect” is mainly manifested in contract disputes, competition disputes and administrative disputes in three aspects;“Sports law” in our country is not logical language,too principle,too much inclined to administrative means and control mechanisms,has softened the marketization of colour,competitive sports and sports“the relevant provisions of the” the lack of a scientific problem,so suggest to revise and improve the competitive sports disputes chapter content,language use,and eliminate the ambiguity of the concept,increasing the “sports law” the fourth＆amp;nbsp;chapter（ sport） rules to do a good job “sports law” the revision and consummation. |
