| 摘 要： | 中国古代社会存在大量调整民商事关系的法律规范。而这些民商方面的法律的生存与发展状况必然受到了中国古代特定社会环境的影响。从"社会的"视角来看,对我国古代民商事法律产生影响的社会因素主要是经济、政治和文化等方面的因素。鉴古明今,我国民法典的制订应从社会实际出发作全盘考虑,以期适合国情、顺应民心、促进我国的社会主义法治建设。

| Abstract: | There were a lot of law adjusting civil and commercial relations in the ancient societies of China. And the existence and development of the civil and commercial law were influenced by the social environment of ancient China, which included such major factors affecting the civil and commercial law of ancient China as economy, politics and culture. From this, an enlightenment could be got. That is, today in modern China, the civil law should be drafted based on the reality of our country, which will promote the process of ruling by law. |
