| 摘 要： | 本文就善意取得制度的来源及其发展、中国民事立法中“善意取得”的发展状况及不足，以及如何构建适合我国国情的善意取得制度进行了详细论证，指出：建立善意取得制度是我国发展经济、完善立法之必须，并从立法指导思想、立法体例、立法原则以及具体构成要件、制度应有之效力等各方面提出了构建我国善意取得制度的基本构想。

| Abstract: | This thesis is intended to elaborate on the origin and development of good-faith acquisition system, its present situation and defects in Chinese civil legislation and how to construct the good-faith acquisition system. That is suitable to or country's conditions. Through comparison and analysis of Chinese and foreign legislation, it is pointed out that the establishment of good-faith acquisition system is required (by our)so as to improve and perfect our legislation. Also, basic suggestion ideas are given on how to frame Chinese good-faith acquisition system from the angles of directing ideas, stylistic layout and principles of legislation as well as its specific components and its fitting effect. |
