| 摘 要： | 通过调查北京市房山区流动摊贩存续的现状，本文分析了流动摊贩的特征，主要从年龄、文化、技能；家庭负担；经营范围及经营模式开展论述。在此基础上探讨了流动摊贩在城市中存在的合理性，最后从城管执法与流动摊贩的行为博弈、城管执法与弱势群体生存矛盾、城管执法方式和城管形象负效应四方面存在的困境进行解析，提出流动摊贩需要政府与社会共同治理，法与情的结合才能发挥更好的效应。应从落实法律法规、弱势群体保障体系、建立摊贩行业协会、公众参与理念四方面提出治理流动摊贩的对策，供政府部门参考。

Governance Difficulties and Countermeasures of Capital Mobile Vendors |

| Abstract: | Based on survey on mobile vendors＇ survival situation in Fangshan district, Beijing, the paper analyzed the characteristics of the mobile vendors, mainly from the perspectives of age, culture, skills, family burden and scope of business and management pattern. And on the basis of the above-mentioned survey, the author discussed rationality of the existence of mobile vendors in the city. Finally in four aspects of behavioral game between Chengguan （urban management officials ） and mobile vendors, existence contradiction between Chengguan and disadvantaged groups, the enforcement mode of Chengguan and their negative image, the author proposed that joint management of mobile vendors between government and society, and combination of law and emotion will achieve better effects. It must put forward the strategy of management mobile vendors from four perspectives： implementation of laws and regulations, weak group security system, establishment of the vendor industry association and the concept of public participation, in order to give reference to relevant government departments. |
