| 摘 要： | 传统刑罚经济学理论界一般认为,国家配置刑罚应该追求以最少的成本支出获取最大的收益。然则,死刑作为五刑之中的特殊刑种,在考虑国家经济效益的同时更需要关注罪刑等价的刑罚基本原理,尤其是在贪利型犯罪中。国家应通过加大死刑成本的投入来限制贪利型犯罪的死刑判处;采取综合治理的方法,实行“社会预防为主,以刑罚处罚为辅”的方针,逐步废除贪利型犯罪的死刑判处。

| Abstract: | According to the traditional penalty economics theory, in the state disposition of penalty, the maximal gains should be sought with minimal cost. So in deciding death penalty, national economic results should be taken into consideration; meanwhile, more attention should be paid to the basic principle of penalty, especially illegal gain of property and corruption. Moreover, comprehensive administration is to be adopted with the policy of "relying mainly on social prevention while making penalty subsidiary" in an attempt to abolish death penalty on illegal gain of property and corruption. |
