| 摘 要： | 在建设服务型政府的社会大背景之下,行政主体利用行政合同方式行使职权的趋势日渐加强。行政合同与民事合同相比具有其独特性,我国应当建立行政合同制度,对于行政合同的法律适用问题有必要进行探讨。

| Abstract: | Under the construction service government＇ s social background, the administrative main body exercises the authority tendency using the administrative contract way to strengthen day after day. Compare with the civil contract, the administrative contract have its distinctive quality, our country must establish the administrative contract system, the question regarding the administrative contract＇ s law application have the necessity to discussion. |
