| 摘 要： | 技术秘密与专利同属于知识产权范畴，但技术秘密不同于专利，具有保密性，不具有排他权，无法定期限，而其实际应用价值大。保护技术秘密已有法可依，企业应增强法律意识，重视对技术秘密的依法保护和管理。

| Abstract: | Although both technical know-how and patents belong to the category of the right of intelligence, the former is of more practical value, as it is confidential, with no exclusiveness and legal deadline. The paper urges enterprisers to impro ve awareness of law, attach importance to protection and management of technical know-how,according to the laws available. |
