| 摘 要： | 2002年陕西董伟"枪下留人"案以来,四年间,社会各界吁请最高人民法院收回死刑复核权的呼声一浪高过一浪.近期曝光的河北聂树斌"冤杀"案、湖北佘祥林"杀妻"冤案,河南胥敬祥"抢劫"冤案,再一次将死刑复核权的收回问题推向高潮.死刑复核权应该上收最高人民法院,已成社会共识,最高人民法院对此也极为重视,专门成立班子论证,并已取得有关部门积极配合,有消息透露,"如果正常,最高法院将在2006年收回死刑复核权".但死刑复核权如何实现上收,复核程序又该如何完善,一时成为中国法律实务理论界共同关注的焦点.

| Abstract: | Since the case of Dongwei's execution of death penalty, all walks of society turn to the highest court for taking back of the power of judicial review of death.Several recent cases taking place in Hebei province,Hubei province etc.,make the discussion heated.It has reached the same point that the power of judicial review of death should be exercised by the Highest Court and the Highest Court has given enough attention and established a special group to settle down this matter.It has been a focus in the lawyers' circle as how to take back and how to enhance the procedure. |
