| 摘 要： | 司法独立是现代法治国家的重要标志和法制现代化的必然要求，坚持和保障司法独立是实现法治的前提。本以党的十六大精神为指引，紧密结合当代中国的政治发展和法制进程，从司法权的独立、司法机关的独立和法官的独立等方面阐述了司法独立的基本内涵，并从权力分立制度、法院组织制度、法官遴选制度、审判程序制度等方面，论述了加强制度建设、用科学的制度体系防范法官的主观随意性、保障司法独立的途径和实现司法公正的目标。

| Abstract: | The independence of justice is an important symbol of a modern country which rules of law, and it is the essential for the modernization of legal system. To persist in and guarantee the independence of justice is the precondition of the realization for the ruling of law. Under the guidance of the spirit of the 16th People's Congress, and closely relating to the politics development and process of rule of law in China. this paper, to expatiate the basic essence of justice independence, is trying to make a comparative analysis in following aspects: the jurisdiction independence, the independence of department of judicature and the judge independence. The viewpoint of the paper is to guarantee the justice independence, the power separation system, the court organization system, the judge selection system, and perfect the judgment procedure system so as to remove the judges' subjective ideas off through the scientific system. |
