| 摘 要： | 现代社会是一个风险社会,侵权现象大量出现,危及社会的安定与和谐。和谐社会应是各方主体的合法权益被尊重和保障的社会。构建社会主义和谐社会离不开侵权责任法规范的调整。侵权责任法的出台是构建和谐社会的必然要求。侵权责任法的价值取向是公正与安全。侵权责任法在构建和谐社会中的价值与功能,一是和谐价值与衡平功能,二是矫正正义与分配正义。
