论房地产权属登记与房地产买卖合同效力的关系

摘    要:从物权法来看,房地产权属登记仅是物权变动的要件,并不影响买卖合同的效力;从债法来看,房地产买卖合同的效力只能以合同的生效要件为判断依据,房地产权属登记不是合同的生效要件,不应当影响买卖合同的效力。

Abstract:Taking it from property law,real property registration is only the essential of real right alteration.It doesn't influence the validity of sale contract;Taking it from contract law,the validity of real property sale contract can only be judged by the executing essentials of contract.Real property registration isn't the executing essential of contract and doesn't influence the validity of sale contract.
