| 摘 要： | 任何制度设计,都是以一定的人性假设作为逻辑起点的。西方社会建立在“性恶”的人性预设基础上的宪政制度有效地实现了限权与法治,但也有明显的弊端。我国过去建立在“性善”的人性预设基础上的制度安排从积极方面鼓励发扬人性中美好的一面,制度约束却过于宽松。要建设有中国特色的社会主义民主与法治国家,必须坚持从我国国情出发,总结自己的实践经验,同时,借鉴吸收西方宪政制度以及我国传统政治文化中的有益成果,正确认识人性问题,作出合理的制度安排。

| Abstract: | In any systematic design,human nature assumption is the logical beginning.The constitutional government system in the western society,which supposes that human nature is evil,has realized the limitafion of the power and governing by law effectively.But it has the obvious shortcomings as well.The systematic arrangement of China in the past,which supposed that human nature was good,encouraged to carry forward the goodNess of the humanity from the positive aspect,but its systematic restraint was too loose.To build a socialist democratic and legal state with Chinese characteristics,we must not only study China's present situafions and summarize our practical experience,but also draw lessons from the benefits of the Western constitutional government system and the Chinese traditional political culture,so that we can realize the humanity correctly and make the reasonable systematic arrangement. |
