| 摘 要： | 我国农村环境问题产生于不平衡的社会经济发展现实与发展模式。当前,我国农民环境权保护中主要存在农村环境保护制度供给不平等、农民环境意识薄弱以及环境维权能力低下等问题。为了更好地保护农村环境、保障农民环境权益,我们应在立法上确立农民环境权,建立农村环境公益诉讼制度,完善对农民的生态补偿制度和农村环境法律援助制度,并建立多种形式的监督机制。

| Abstract: | China＇s rural environment problems arise from the developing reality and model of the unbalanced social economy. At the present, the problems such as unbalanced supply in environmental protection system, the poor sense of environment among farmers and low ability of defending rights in environment exist in farmers＇ environmental protection right. In order to protect the rural environment, guarantee the farmers＇ rights and benefits in environment, it＇s necessary to assure the farmers＇ right in the law, set up the system of public welfare lawsuit on rural environment, perfect ecological compensation, law assistance systems for farmers, and perfect all sorts of supervisory mechanism. |
