| 摘 要： | 《刑法修正案（八）》已将社区矫正写入刑法，但我国仍无专门的社区矫正法，况且目前的社区矫正存在适用范围过窄的问题。对此，应当将限制人身自由的行政处罚和在机构外实施的保安处分的内容纳入到社区矫正的立法当中；在立法体例上宜采取综合性立法体例，并按照“两步走”的思路进行立法，即先制定单行社区矫正法律以应急需，待条件成熟再将其整合为一部体系规范、内容齐全、结构严整的社区矫正法典。

| Abstract: | Community correction is written as criminal law in the Eighth Amendment to the Criminal Code. But there is still no special code of community correction in China. At present, the applied scope of the community correction is too narrow. So, it＇s necessary to put administrative penalties restricting personal freedom and security measures outside the organization into the field of community correction. Comprehensive legislative style is appropriate for community correction Legislation in china, and we should follow ＂two steps＂ in legislation, namely ： single laws of community correction should be made first to meet the urgent needs of practice ; if conditions permit, a code of community correction with well-disciplined sector, complete content and tight structure is integrated. |
