| 摘 要： | 以《民法总则》建立的民事活动中应当有利于节约资源、保护生态环境的"绿色原则"为基础,作为原则性规定,"绿色原则"的精神势必表现于民法典的各分编中。经过两次审议的民法分则草案在物权编、合同编、侵权责任编中,分别在《物权法》《合同法》《侵权责任法》的基础上沿袭或增加关于节约资源、保护生态环境的规则设计。"绿色原则"入民法是一项重要立法举措,但是在各分编体现"绿色原则"的规则中还存在"绿色"条款不健全、系统性欠缺等有待改进的问题。

| Abstract: | Based on the "green principles", it established in the general principles of Civil Law that should be conducive to saving resources and protecting the ecological environment in civil activities. As a principled provision, the spirit of the "green principles" is bound to be manifested in the various sections of the civil code. The draft civil law sub-rules after two deliberations have inherited or added information on resource conservation and ecological environment protection based on the Real Property Law, the Contract Law, and the Tort Liability Code, respectively. Rule design. The entry of the "green principles" into the civil law is an important legislative initiative, but there are still problems in the rules that embody the "green principles" in various sub-sections to improve the"green"clauses and lack of systemicity. |
