| 摘 要： | 马克斯·韦伯认为,西方的法制现代化的是一个日益形式合理性的过程.这一过程的发生既有裁判方式的变革、法律教育的方式、法学者群体的形成、法律实务者的利益取向、对罗马法的继承等内在因素的驱动,也受政治权力、经济条件、宗教的理性化等外在因素的影响.他的考量对于我国法制现代化的启示有:将政治权力对法制现代化的主导地位纳入法治机制;通过发展市场经济形成具有独立利益主张的市民阶层;法律职业者共同担负起推动法制现代化的使命;基于我国法制现状正确定位法学教育模式.
