| 摘 要： | 人口老龄化是我国面临的一个现实问题。由于老年人在总人口中的比重增加，老年人犯罪的绝对数量及在犯罪中的比例也有不断上升的趋势。而老年人犯罪及刑事责任的研究在刑法理论界仍很薄弱。因而研究这一问题具有重要的理论与实践意义。本文借鉴古今中外刑事立法对老年人犯罪的具体规定，结合老年人自身的生理、心理等特点与我国的实际，着眼于老年人犯罪的刑事责任提出了自己的意见与看法。

| Abstract: | Aging of population is an actual problem in our country.The absolute value and the rate of the crime committed by the old are increasing.However,the study for criminal responsibility of the aged is still very weak in the circle of criminal theory.Therefore,studying this problem has an important theoretical and practical meaning.This paper uses the concrete regulations which exist at all times and in all lands for reference,and combine the old's physiology and psychology with China's reality to raise the writer's views for the old's criminal responsibility. |
