| 摘 要： | 以宪法限制国家权力和以国家权力为主导推动宪法发展是宪法学关于宪法与国家权力的两种基本理论倾向，这两种认识均具有一定的片面性，在实践中难以形成良性互动关系。在以宪法限制国家权力并推动其正义化运作的同时，发挥国家权力的积极能动性推动宪法发展，从而实现宪法与国家权力的良性互动。这种关系应在我国当今宪政建设中得到实现。

| Abstract: | To limit state power by constitution and to promote the advance of constitutions by the main role of government are the basic theory concerning the relationship of state power and constitution. They are both unilateral. It is difficult to form a benign mutual promoting relationship between state power and constitution. State power active role should be used to promote the advance of constitution when it's confined by constitution, so that its justice in this condition, the benign mutual promoting relationship can form. This kind of relationship should be realized in the course of today's construction of constitution politics in China. |
