| 摘 要： | 根据文字作品中的角色改编是否侵犯改编权在司法实践中观点不一,不仅在改编类型上体现出侵权判断的不同,即使都改编为视听作品,文学角色及其相关元素或被认为必须要与特定故事情节结合才能保护,或被认为具有独创性可以单独保护。目前司法实践中多采用抽象测试法判断文学角色及其相关元素是否为思想,但该方法存在局限性和适用困难。为防止对"思想-表达二分法"的僵化适用抑制公众对人物角色设计的创新,实践中除抽象测试法之外,应重视结合适用整体感观法判断改编权侵权问题,即在判断文学角色是否能作为改编权的客体时,应当融入普通理性人对原作基本独创性表达的判断,看文学角色及其相关元素是否被充分开发后形成独特的性格内涵,以及是否与原作形成渊源关系。

| Abstract: | In the judicial practice,arguments vary in whether the adaptation of the roles from original literary works violates the adaptation right.Infringement judgements differ not only in the type of adaptation,but even being adapted as audiovisual works,literary roles and their related elements may be considered to be protected in combination with a specific storyline,or can be protected individually if they are considered to be original.At present,the abstract test method is usually used to judge whether the literary role and its related elements are thoughts in the judicial practice.However,this method has limitations and difficulties in application.In order to prevent the rigid application of the"thought-expression dichotomy"from inhibiting public innovation in the design of character roles,it is required to pay attention to the application of overall perception method to determine the infringement of adaptation right in practice except the abstract test method.In other words,when judging whether the literary role can be used as the object of adaptation right,the judgment of ordinary rational people on the basic original expression of the original work should be incorporated to see whether the literary role and its related elements have been fully developed to form a unique character connotation,and whether it has a relationship with the original work. |
