| 摘 要： | 中国古代契约制度，开始于商周时期，经过秦、汉、唐、宋、明、清等封建社会长时间的发展，形成了中国古代传统的契约制度。针对中国古代契约制度的发展和研究，可以明晰契约制度发展的轨迹，了解经济和社会文化因素对契约制度所产生的影响，从而完善当代的合同制度。现代契约主要有主体、客体和内容三要素。文章根据这三要素从古代契约的主体、形式的变化和内容方面来探讨中国古代契约制度的发展。了解社会变迁对中国古代契约制度的影响。

| Abstract: | The contract system in China started from Shangzhou dynasty, experienced Qin, Han, Tang, Song, Ming, and Qing period and developed into Chinese traditional contract system. Studies on its development can see the trace and chain of its development. Understand the effect of social cultural factors on contract system can promote modern contract system. Modem con- tract system includes three essentials：subject, object, and content. According to the three essen- tials, the development of Chinese ancient contract system is discussed from the aspects of the subject, formal change and content so that we may see the influence of social change |
