| 摘 要： | 产品质量问题已经成为影响中国从制造大国走向制造强国的关键因素。而造成中国产品质量低劣的主要原因,却并非科学技术水平的阻碍,更多是由于相关产品责任法律制度的不健全,没有起到应有的制裁、规范、导引作用。美国是当今世界产品责任法最为发达的国家,研究其演进历程留给我们十分丰富的启示。只有让我国的产品责任法律真正由管理法向救济法转变,着力加强对于消费者在诉讼中的保护,才能做到整个国家产品质量的跨越式提升。

| Abstract: | Products quality a powerful manufacturing is the key factor that affects country. The main reason of China＇s going from a big manufacturi low quality of Chinese products is not ng country to the hindrance of scientific technology. The main reason for that is the insufficiency of Chinese products liability law, which doesn＇t perform its function of punishment, regulation and guidance. America can teach us a lot in this field because it has experienced an entire process of enhancing the product quality from an extremely low level. The key is only by changing the law of products liability law to relief law and strengthening pro- tecting consumers in law suits can we promote the products quality in China in big step. |
