| 摘 要： | 秦汉奴婢所犯奸罪主要有强奸、和奸、禽兽行三种。秦汉法律对犯奸罪的奴婢的惩罚要重于其他人，而且会因受害者身份不同而不同。一般而言，法律对奴婢在家庭内部所犯奸罪惩罚最重，反映出秦汉家庭中主奴之间严格的等级界限，以及法律对家庭内部伦理关系的维护；相比之下，对奴婢在家庭关系之外所犯奸罪惩罚较轻，这在一定程度上反映出秦汉时期较为开放的社会风俗。秦汉时代社会等级制度尚未严格化，这使得奴婢的身份较易得到改变。

| Abstract: | The illicit sexual crimes committed by slave maids in Qin and Han Dynasties fall into three categories, namely rape, adultery, and animalistic atrocity. Punishments for the slave maids are often harsher than those for other people, which also vary on the basis of the social status of the victims. Gefierally speaking, domestic illicit sexual crimes receive the harshest treatments, an indication of the legal protection of distinctive domestic hierarchy between master and slave and efforts to maintain household morality. In comparison, less severe punishments are meted out for the same crimes committed outside the family relationship, which reflected relatively open social mores in Qin and Han societies. The hierarchy system was not yet rigidly solidified, for slave maids to change their social statuses and identity. making it possible for slave maids to change their social statuses and identity. |
