| 摘 要： | 在经济全球化、人口老龄化和经济体制改革等社会背景之下，我国社会保障制度的建立和完善是一个不断进行改革的过程。社会保障法律制度以保护全体社会成员的社会保障权利为宗旨，但是并不能由此而进行不切合实际的权利保护承诺，从根本上使社会保障法律形同虚设。构建我国社会保障法主体的体系和对主体的权利义务进行分配时，要对主体在社会保障法领域内的利益进行平衡。

| Abstract: | The foundation and improvement of the social security system in China is a long process according to the economic globalization, the aging of population and the economic system reformation. As a basic system, social security is to protect all persons. But the standard of the social security should match the development of the society and economy. The establishment of the subject system in China should be directed by Benefit-Balance theory. |
