| 摘 要： | SARS疫情等公共危机暴露出的我国应急法制的薄弱环节。虽然说我国在构建突发事件应急法律体系方面具有一定基础,但缺少突发事件应急处理基本法律作为“龙头”,一些领域的应急法律规范仍不健全,许多突发事件应急处理立法的可操作性不强,已有的应急法律规范执行不到位,公共应急法制的实施环境有待改善。从指导思想来看,很长一个时期以来法学界和实务界忽视了行政应急性原则在整个行政法制建设中的应有地位和作用。必须注意将行政应急原则列入我国行政法的基本原则体系,发挥其应有的理论指导作用。借鉴其他国家应急法制的特长,我国应在应急法制建设的目标、原则与重点方面做出专门的立法。

| Abstract: | The epidemic stuation of SARS exposes the construction of emergency legality has some base in our country, but there is no basic law for emergency as "leader". The regulation in some areas is not perfect. The means to cope with emergency is not practical. The regulation is not carried out complerely. The regulation is not carried out completely. The environment of coping with the public crisis should be improved. At the view of guiding thought, the principle of emergency of administration legality. For a long period, we must put the Principle of administration emergency into the system of administration legality and pays its guiding part. Learning from the features and tendency of emergency law of other countries, we should make Legality on the god, principle and emphasis of construction of emergency law. |
