| 摘 要： | 中国经济法学是一门历史较短的学科.经济法学说史宜采用两分法和分期特例来进行分期.两分法是以1992年为界,1992年以前是中国经济法学的萌芽时期,亦称"经济法学说老诸论";1992年以后为中国经济法学的发展时期,亦称"经济法学说新诸论".经济法学说的分期特例是"国家调节说".该理论认为,经济法是沿着"市场三缺陷—国家调节三方式—经济法体系三构成"这样一个过程而产生的.该学说又称"三三理论".通过合理的分期,我们可以将各家经济法学说纳入特定的时期进行研究.
