| 摘 要： | 元代出军制度起源于蒙古习惯法,入元后进入元代刑法体系成为减死一等的重要刑罚,仁宗延祐年间进一步发展,分为两个等级,构成了元代的流刑。元代流刑由于是在出军的基础上形成的,因此呈现岀与其他朝代不同的特点。元代出军制度的发展过程,很好地反映了蒙古习惯法与汉法相互结合与渗透的过程。

| Abstract: | The exile system in Yuan Dynasty came from Mongolian's unwritten law and turned into an important penalty for guilty just below the death penalty.At the YanYou period,it was developed into two grades to form the banishment penalty of Yuan Dynasty.As it was formed on the basis of exile,it made the banishment of Yuan Dynasty very unique.The progress of the exile system is a good example to represent the combination of law between Mogolia and Han nations. |
