| 摘 要： | 在民族地区刑事审判制度中对少数民族风俗习惯的适度尊重是少数民族权益保障的重要内容。尽管我国尚未制定相应的变通刑事法律，但在实践中，法官却对刑法在民族地区的实施予以一定程度的变通适用。我国法官选任条件中没有完全照顾到民族地区的特殊情况，这可能会导致我国民族地区法官出现青黄不接的局面。因此应抓紧时间制定刑事法律的变通或者补充规定，降低法官的选任条件，使民族地区刑事审判制度中的少数民族民族权益得到相应保障。

| Abstract: | It is very important to pay more attention to the minorities' customs in criminal justice in ethnic-minority areas.Although we have not made the adaptive criminal law in our country,the judges in the areas have adapted to carry out the criminal law sometimes.We have not paid much attention to the special circumstance about the selecting judges in these areas.There will be not enough judges in our ethnic-minority areas.Therefore,we should make the adaptive or additional regulations to lower the requirements of selecting judges and protect minorities' rights and interests in criminal justice in Chinese ethnic-minority areas. |
